These Terms & Conditions apply to all services provided by 25HOUR ApS (CVR no. 39261960), Birkedommervej 31, 1st floor, 2400 Copenhagen NV, Denmark. By engaging our services, you accept these terms in full.
25HOUR ApS provides video production, livestreaming, photography, graphic design, and related creative services. For equipment rental, separate Rental Terms & Conditions apply and are available at 25hour-rental.dk.
Quotations are valid for 30 days from the date of issue unless otherwise stated. A binding agreement is formed when the client accepts a quotation in writing (including email) or signs a separate project agreement.
Quotations are based on the information provided by the client at the time of the request. If the scope, timeline, or requirements change after a quotation has been accepted, 25HOUR reserves the right to adjust the price accordingly and will inform the client before proceeding.
The scope of work is defined in the accepted quotation or project agreement. Any changes or additions requested after the agreement must be confirmed in writing and may result in adjusted pricing and delivery timelines.
Pre-production planning, concept development, and scripting are included only if explicitly stated in the quotation.
All prices are stated in DKK and are exclusive of VAT (25%) unless otherwise noted. Payment terms are net 14 days from the invoice date unless otherwise agreed.
For projects exceeding DKK 50.000, 25HOUR may require an advance payment of up to 50% before production begins. The remaining balance is invoiced upon delivery.
Late payments will incur interest in accordance with the Danish Interest on Overdue Payments Act (Renteloven). 25HOUR also reserves the right to charge a reminder fee of DKK 100 per reminder.
Cancellations must be made in writing. If the client cancels more than 14 days before the scheduled production date, 25HOUR will charge for documented costs incurred up to the point of cancellation.
If the client cancels 14 days or fewer before the scheduled production date, the full agreed price will be charged unless 25HOUR is able to reallocate the resources to another project.
Postponements are treated as cancellations unless a new date is agreed in writing within 5 business days.
Estimated delivery dates are provided in good faith but are not guaranteed unless explicitly confirmed in writing. 25HOUR will inform the client without delay if delivery is expected to be late.
The client is entitled to up to two rounds of revisions on delivered material unless otherwise specified in the quotation. Additional revisions will be charged at 25HOUR’s current hourly rate.
Delivered material is considered approved if the client does not provide feedback within 10 business days of delivery.
25HOUR retains full copyright and intellectual property rights to all produced material until full payment has been received. Upon full payment, usage rights are transferred to the client as specified in the quotation or project agreement.
Unless explicitly agreed otherwise, usage rights are granted for the client’s own marketing and communication purposes. Resale, sublicensing, or distribution to third parties requires separate written consent from 25HOUR.
25HOUR reserves the right to use delivered material in its own portfolio, showreel, and marketing channels, including its website and social media, unless explicitly excluded in writing.
Raw footage and project files remain the property of 25HOUR unless otherwise agreed. 25HOUR stores raw footage for a maximum of 90 days after final delivery, after which files may be deleted without notice.
25HOUR’s total liability towards the client, regardless of the basis for the claim, cannot exceed the total fee paid for the specific project in question.
25HOUR is not liable for any indirect losses, including but not limited to loss of profit, loss of data, loss of goodwill, or consequential damages.
25HOUR is not liable for delays or non-performance caused by circumstances beyond its reasonable control, including illness, equipment failure, extreme weather, natural disasters, pandemics, or any other force majeure event.
Both parties agree to keep confidential any non-public information shared during the course of the project, including concepts, scripts, pricing, and business information. This obligation continues after the project has ended.
25HOUR may engage subcontractors (such as freelance crew, talent, or post-production specialists) to deliver the agreed services. 25HOUR is responsible for the performance of any subcontractors used.
If the client requires specific licenses, music rights, stock footage, or other third-party assets, these costs are the client’s responsibility unless included in the quotation.
The client is responsible for providing necessary materials, approvals, access to locations, and any other prerequisites for 25HOUR to deliver the agreed services on time.
The client warrants that it holds the rights to any material provided to 25HOUR for use in production, including logos, images, text, and music. The client shall indemnify 25HOUR against any claims arising from the client’s material.
These Terms & Conditions are governed by Danish law. Any dispute shall first be attempted resolved amicably between the parties. If no resolution is reached, the dispute shall be settled by the Copenhagen City Court (Københavns Byret) as the court of first instance.
25HOUR reserves the right to update these Terms & Conditions. The most current version will always be available on 25hour.dk. For ongoing projects, the terms that were in effect at the time of the agreement will apply.
